يخطئ الكثير من الناس بحصر حقوق الملكية الفكرية بحقوق المؤلف فقط، متجاهلين بقية الحقوق الصناعية والتجارية كالاختراع والعلامات التجارية وغيرها، وثقافة حق المؤلف عرفها العرب منذ القدم، ولم يكن هناك ثقافة الملكية الفكرية الصناعية والتجارية كالاختراع والعلامات التجارية لأنها وليدة عصر النهضة بأوروبا، ومورس حق المؤلف بأبهى صوره من خلال احترام الشاعر وانتفاعه بشعره مادياً من خلال الهبات والمنح التي يتلقاها من الأمراء وشيوخ القبائل، فالشعر ديوان العرب، وأيضاً تجلى هذا الاحترام لحقوق المؤلف وتقديس المبدع بتعليق النتاج الشعري المميز لعدد من الشعراء العرب على جدران الكعبة، أقدس مكان لدى العرب، وفي عصور تالية دخل النثر وأصبح هناك كتب تعنى بالنثر الأدبي والعلمي وغيرها، وذكرت كتب التاريخ والكتب الأدبية قصص صراعات كبيرة على نسب بيوت الشعر لهذا الشاعر أو ذاك، في المجمل كان هناك احترام للمنتج الإبداعي ولصاحبه.

    The WIPO (see the Convention Establishing a World Intellectual Property Organization) notes that there is "an increasing tendency towards establishing organizations or associations for group administration" because of the weakness of the individual inventor and his need to legal and administrative protection and supervision due to "the growing global utilization of musical and literary compositions". Those associations aim at achieving advantage to their members "through their experience in the legal and administrative field", and collecting the resultant financial rights of making use of their members' compositions.

   There is no doubt that respecting the author's right in his creative composition is an old historical culture known by Arabs. The treaties and modern laws that regulate this protection are just a translation of this culture, as a result of the human development and the complication of human transactions.

Inventor's rights are among copyrights

   Copyrights extended to cover most kinds of individual's creative thought. They are legally protected in a way through which the inventor and his successors can invest this invention in any way they find suitable; whether it is by selling all his creative property rights to a certain group through which it can publish his creative "literary or artistic" product and distribute it as wanted. This group, which has the authority of using this creative work, may translate it into other languages. Or by getting permission of the right's owner to use the work (such as publishing a certain number of copies only once, or translating it into a certain language and publishing it… etc.).
